
Uncontested and Contested
There are essentially two types of divorce, Uncontested and Contested.
Generally, "uncontested" divorces arise when both parties are in agreement as to all of the issues in the marriage. The rights and responsibilities of the parties can then be set forward in a Marital Settlement Agreement, and that agreement must be approved by a judge. Due to the fact that the parties are in agreement, it is often a swift and inexpensive way to obtain a divorce.
"Contested" divorces, on the other hand, can take considerable time and money to resolve. The term "contested" refers to one or more marital issue that simply cannot be worked out between the parties and thus must be presented to a judge who then makes a final decision on the issue. It is in both party's best interests to resolve as many things as possible between themselves if at all possible. For every issue that must be resolved, the process becomes longer and more costly for all involved.
